AVVO Profile
I’ve been hurt on the job. Do I have a Workers’ Compensation case?
Workers compensation is a no fault system which provides benefits for injuries at work. This means that so long as you suffered an injury while working, fault of the injury is not relevant: the employers, your own fault, a co-workers, someone other than your employer. If your injury happened at work, you should get workers compensation benefits for your injury.
How much money am I going to get for my workers’ compensation injury?
Permanent Disability is a benefit that compensates you for your injury. At the end of your case, your treating doctor or evaluating doctor (Agreed Medical Evaluator or Panel Qualified Medical Evaluator, Primary Treating Doctor) will write a report describing your impairment, which later is converted to a permanent disability percentage. The higher the disability the more money you may receive. This happens after your condition is “permanent and stationary.”
Can an attorney help me get the medical care that I need in my workers’ compensation case?
In most cases. Most, if not all, injured workers get referred to company doctors and clinics who are unsympathetic at best. Additionally, the insurance company will use Utilization Review (companies that decide if treatment requested by your doctor is approved or denied) to deny and limit medical treatment. A workers’ compensation attorney will evaluate your case and injuries and help you select an appropriate treating doctor. Relationships with these doctors can often lead to much better communications about the goals for treatment and for the outcome of a settlement.
